Hunnisett Family History

This is the last Will and Testament of me Richard Hunnisett of Herstmonceux in the County of Sussex Looker touching the disposition of such temporal Estate as it hath pleased Almighty God of his Goodness to bestow upon me (that is to say)

I give devise and bequeath unto William Lock of Wartling in the County aforesaid Yeoman All and every my Messuages Buildings Lands Tenements Hereditaments and Real Estates whatsoever and wheresoever as well Copyhold as Freehold with their and every of their Rights Members and Appurtenances And also all my Goods Chattels Effects Monies Securities for Money Rights Credits and personal Estate whatsoever and wheresoever To hold the same unto the said William Lock and his Heirs Executors and Administrators forever Upon the several Trusts nevertheless hereinafter declared of and concerning the same (that is to say) Upon Trust that he the said William Lock or his Heirs and Executors or Administrators shall and do as soon as conveniently may be after my decease absolutely sell and dispose of my said Messuages Buildings Lands Tenements Hereditaments and Real Estates and also such part or parts of my said personal Estate as shall be of a saleable nature for the best price or prices that can be had or obtained for the same either by public Auction or private Contract and either together or in lots or parcels as he the said William Lock or his Heirs and Executors or Administrators shall in his or their discretion think most adviseable And the Monies arising from the Sale or Sales thereof together with the Rents Issues and profits of my said Real Estates in the meantime and until the Sale and Disposition thereof and also such Debts or Monies as shall form part of my said personal Estate to pay and apply in manner following (that is to say) in the first place in discharge and satisfaction of all such Debts as I shall justly owe at the time of my decease my Funeral Expenses and the Costs and Charges of proving and executing this my Will And after payment and satisfaction thereof Upon Trust that the said William Lock or his Heirs and Executors or Administrators shall and do pay and divide the residue of the said Trust monies unto and between my Daughters Ann Hoad and Sarah Rich or their respective Executors Administrators or Assigns in equal shares and proportions to and for their several and respective Use and Uses.

And in order to so facilitate the Sale and Disposition of my said Real Estates in pursuant to this my Will I do hereby expressly declare and direct that the purchaser or purchasers thereof his her or their Heirs Executors Administrators or Assigns shall not be compelled or compellable to see to the application of his her or their purchase Money or purchase Monies or any part thereof or be answerable or accountable for the Loss Misapplication or nonapplication thereof or of any part thereof but that such purchaser or purchasers and his her or their Heirs Executors Administrators and Assigns shall be absolutely discharged therefrom upon payment of such his her or their said Purchase Money or in purchase Monies unto the said William Lock or his Heirs any Rule of Law or Equity to the contrary notwithstanding And I nominate constitute and appoint the said William Lock sole Executor of this my last Will and Testament And I do hereby expressly declare and direct that he my said Executor and Trustee or his Heirs Executors or Administrators shall not be charged or chargeable with or accountable for any more of my Monies or Estate than he or they shall respectively actually receive or come to his or their respective Hands by virtue of this my Will nor with or for any Loss which may happen if such Monies or Estates or any part thereof so as such Loss do not happen by or through his or their wilful default or neglect And further that it shall and may be lawful to and for my said Executor and Trustee and his Heirs Executors and Administrators to retain to reimburse himself and themselves respectively from and out of my said Monies and Estate all such Loss Costs Charges Damages and Expenses as he or they shall respectively sustain bear pay expend or be put unto in the Execution of this my Will or in or about any other Matter or Thing in anywise relating thereto And lastly I hereby revoke all former Wills by me made and declare this only to be my last Will and Testament In witness whereof I the said Richard Hunnisett have to the two first Sheets of this my Will contained in three sheets of paper set my Hand and to this the third and last Sheet thereof my Hand and Seal the seventeenth day of February in the year of our Lord One thousand eight hundred and twenty six

signed sealed published and declared by the above named Richard Hunnisett as and for his last Will and Testament in the presence of us who in his presence at his request and in the presence of each other have hereunder subscribed our names as witnesses the words "Herstmonceux" in the fifth line of the first sheet having been first erased & the words "Wartling in the County" having been first interlined between the fourth & fifth lines of the same Sheet

The Will of Richard Hunnisett late of Herstmonceux within the Archdeanery of Lewes Looker deceased was proved the eighteenth day of June in the year of our Lord One thousand eight hundred and twenty seven Before the Reverend Thomas Fuller Clerk Surrogate and so forth Upon the Oath of William Lock the sole Executor in the said Will named To whom was committed the Administration of the Goods etc He being first sworn well and faithfully to administer the same and so forth Sworn also that the Goods Chattels and Credits of the said deceased do not amount in value unto three hundred pounds
