In the Name of God Amen I Edward Honeysett of the Parish of Smarden in the County of Kent Farmer being of sound and disposing Mind Memory and Understanding praised be God for the same do hereby make ordain and publish this my last Will and Testament in manner following that is to say in the first Place I will and direct that all my just Debts Funeral Expences the Cost and Expences of proving this my will and all other incidental Charges and Expences be fully paid and satisfied

And I Give and Bequeath unto Thomas Sharp Hope Son of my wife Eleanor for and during the term of his natural Life the Occupation of my Messuage or Tenement Farming Buildings and Appurtenances thereto belonging with Fifty six Acres of Land more or less situate lying and being in the said parish of Smarden and now in my own Occupation and Residence Subject to the Payment of Four Shillings per Week to be paid unto my said Wife for and during the term of her natural Life in half yearly payments the first of which payments to begin and be made at the Expiration of six Callender Months after my Death And also subject to be payment of Eighteen Pounds yearly to be equally divided between my two Nephews Edward and Thomas Honeysett Sons of my Brother James late of Warbelton in the County of Sussex for and during the term of their natural Lives their respective Heirs and Assigns the first of which Payments to begin and be made at the Expiration of twelve Callender Months next after my Death And I do hereby subject charge and make liable my aforesaid Messuage or Tenement Lands and Premises with the payment of the aforementioned Sum And I do direct that he the said Thomas Sharp Hope shall be liable to the payment of the Land Tax and all other Taxes which shall or may be levied on the said Farm and Premises during his Occupation thereof and shall not have Power to cutt down any of the timber or timber like Trees growing thereon And I Give and Bequeath unto the said Thomas Sharp Hope any Horses Cows Bullocks Sheep any Farming Implements Waggons Carts Ploughs and Harrows Crops of Corn in the Land Hay Straw and Manures and which live Stock Implements of Farming shall be on the said Farm at the time of my Decease And I Give and Bequeath unto the said Thomas Sharp Hope my Copper my Tubs Kealers Barrells Brine Tubbs and the whole of my Dairy Utensils

And I direct that at the death of Thomas Sharp Hope aforesaid no Allowance shall be made to his Heirs for the Corn and Manures which may then be in the said Land nor the whole of the Hay and Straw which may be then on the said Farm and that no Part of the same shall be subject to Valuation And from and after the Decease of the said Thomas Sharp Hope I Give and Devise the said Messuage or Tenement Farming Buildings Lands Hereditaments and Premises with Corn and Manures in the Land and also the Hay and Straw which may be thereon equally between my said two Nephews Edward and Thomas Honeysett Sons of my late Brother James as aforesaid their respective Heirs and Assigns for ever Subject to the payment of the weekly Sum of Four Shillings to my Wife as aforesaid Provided always and my Will further is that my Executors hereafter named shall have power during the Occupation of the said Farm by Thomas Sharp Hope as aforesaid from time to time to cut down such timber Trees only as shall in their Judgement and Discretion be necesary for the repairing the said Messuage or Tenement Farming Buildings and Fences on the said Farm And I do also give and reserve unto the said Farm a right of Waggon Road through my other Farm called the Taylor Land and now in my own Occupation to and from the Turnpike Road leading from the Town of Charing to Biddenden

And I Give and Devise All that my Messuage or Tenement now in three Dwellings with Outbuildings and Appurtenances thereunto belonging with Six Acres of Land more or less called the Taylor Land as aforesaid and now in my own Occupation unto my Nephew Thomas Honeysett Son of my Brother David late of Staplehurst his Heirs and Assigns forever Subject to the payment of two Shillings per week to be paid unto my said Wife for and during the Term of her natural Life in half yearly payments the first Payment to begin and be made at the Expiration of six Callender Months next after my Death And I do hereby subject charge and make liable my said Messuage or Tenement Land and Premises called the Taylor Land with the payment of the said Sum of Two Shillings per week to my Wife as aforesaid

And I Give and Bequeath unto my said Wife my best Feather Bed with Sted Hanging and Healing and all which to such best Bed may belong my Corner Cupboard and Dresser the whole of my Linen or such Parts thereof as shall be considered fully sufficient for her Use and Comfort

And I Give and Bequeath a Legacy or Sum of Fifty Pounds unto Lydia Witherden of Biddenden Widow Daughter of my said Wife Eleanor her Heirs and Assigns and my Will is that the said Legacy shall be paid at the End of twelve Callender Months next after my Death

And I Give unto my hereafternamed Executors the Sum of two Pounds to be equally divided between them share and share alike

And my Will is that my Funeral shall be as private as Decency will admit of and I Give the sum of two Shillings and a pair of usefull Gloves each to six Persons who may be appointed to convey my Body to the Place of Interment

And as to the rest and residue of my Estate and Effects Monies and Securities for Monies whatsoever and wheresoever and of what Nature and Kind the same may be of or which may be due owing or belonging unto me at the time of my Death Subject to the Payment of my just Debts Funeral and testamentary Expences __ aforesaid as also the Legacys hereby given I Give the same and every Part thereof to be equally divided between and amongst my Nephews James Mitchell and Henry Mitchell of Dallington Sussex Sons of my late Sister Elizabeth William Honeysett of Headcorn Son of my late Brother John William Pettit of Maidstone Son of my late sister Sarah William Honeysett of Charing and Mary Murton of Egerton Son and Daughter of my late Brother William their respective Heirs and Assigns share and share alike trusting they will be satisfied with what I have hereby bequeath unto them

And I nominate constitute and appoint my esteemed friends Benjamin Elgar Farmer and John Wood the Elder Farmer both of the said Parish of Smarden Joint Executors of this my Will and Trustees thereof and it shall be lawful and right for them my said Executors or the Survivor of them from and out of my Estate and Effects coming to their Hands to reimburse himself and themselves all such losses Charges Costs and Expences which they or either of them may be at or expend or be put unto in the Execution of this my Will and the Trust thereof and further that they my said Trustees or the Survivor of them shall not be answerable or accountable for any loss or misapplication of my Estate and Effects or any Part thereof without their or his wilful Neglect and Default and not the one of them for the other of them but each of them only for his own separate Acts Neglects and Defaults In witness whereof I the said Edward Honeysett the Testator have to this my last Will and Testament contained in this and the two preceding Sheets of Paper together anexed set my hand and seal to wit my hand only to the two preceding Sheets and my Hand and Seal to this the third and last Sheet thereof this twenty fourth day of May in the Year of our Lord One thousand eight hundred and thirty seven making null and void all former and other Wills and Codicils by me at any time heretofore made and declaring this only to be and contain my entire last Will and Testament - Edward Honeysett - Signed sealed published and declared by the within named Edward Honeysett the Testator as and for his last Will and Testament in the Presence of us who at his Request and in his presence and in the presence of each other have hereunto subscribed our names as Witnesses

The before registered Will of Edward Honeysett deceased was proved the twenty eighth day of April 1840 before the Reverend John Pechey Francis Clerk Surrogate to the Worshipful John Nichol Doctor of Law Vicar General of his Grace William by Divine Providence Lord Archbishop of Canterbury Primate of All England and Metropolitan lawfully constituted by the Oaths of Benjamin Elgar and John Wood the Elder the Executors named in the said Will They being first sworn duly to perform the same.
